What is the difference between a Wagg motion & a Norwich order?

A Wagg motion or rule 30.10 motion (Ontario Rules of Civil Procedure) is used to compel someone who is not a party to litigation to share relevant information, for example, police investigation records. A Norwich order serves the same purpose. The main difference is that a Norwich application is filed prior to the start of pleadings, whereas a Wagg motion is filed once the proceeding has been initiated, for example after filing a statement of claim.

The Norwich order is used as a pre-action discovery tool, often used to identify the wrongdoer and to assess the merits of the potential action, prior to commencing litigation.
